Qwen is Alibaba Group's AI model family, developed by Alibaba Cloud's Tongyi Lab in Hangzhou, China. Most Qwen models ship under Apache 2.0, but recent flagship releases (Qwen3.8-Max, Qwen3.7-Plus, older 72B-class models) use custom licences that require a separate commercial agreement above defined revenue or user thresholds. For EU regulated customers the key considerations are Chinese jurisdiction over the parent entity (distinct from, but analogous in effect to, US CLOUD Act exposure), Alibaba's recent placement on a US Department of Defense list of Chinese military-linked companies, and the fact that neither Alibaba nor Qwen has signed the EU's voluntary GPAI Code of Practice.
